The High Court is expected to rule on Thursday, July 23, on an application by former National Food Buffer Stock Company (NAFCO) Chief Executive Officer, Hanan Abdul-Wahab Aludiba, seeking to have the criminal charges against him dismissed on the grounds that they are legally defective and violate his constitutional right to a fair trial.
Mr Aludiba’s legal team, led by former Attorney General Godfred Yeboah Dame, argues that the charges are fundamentally flawed and incapable of sustaining a criminal prosecution. According to the defence, the way the charges have been framed breaches their client’s constitutional right to a fair hearing, and the case should therefore be struck out before trial begins.
The application is being opposed by the Republic, represented by Deputy Attorney General Dr Justice Srem-Sai, who maintains that the charges are legally sound and that Mr Aludiba should stand trial to answer the allegations against him.
Counsel for Mr Aludiba’s wife, Augustine Obour, told the court that they were adopting the submissions made on behalf of the former NAFCO CEO. Should the application succeed, his wife is also expected to benefit from the court’s decision.
Justice Francis Apangabonu Achibonga, a Justice of the Court of Appeal sitting as an additional High Court judge, is scheduled to deliver his ruling at 10:00 a.m. on July 23, 2026. The decision will determine whether the prosecution can proceed with the case or whether the charges will be dismissed at this stage.
The case is part of ongoing legal proceedings involving the former NAFCO Chief Executive. Earlier this month, Mr Aludiba filed a habeas corpus application challenging his arrest and detention after he was arrested at Kotoka International Airport while preparing to travel abroad for medical treatment under a court-approved arrangement.
Although the court dismissed that application, his legal team has continued to challenge various aspects of the prosecution, including the validity of the charges now before the High Court.
