The Ashaiman District Court has remanded a 43-year-old soldier into police custody over the alleged murder of a man at Mawugbedzibe, near Afienya in the Greater Accra Region.
Warrant Officer Class II Dzisenu Ben has been charged with the murder of 45-year-old Abdul Shaban, contrary to Section 46 of the Criminal Offences Act, 1960 (Act 29).
His plea was not taken when he appeared before the court, presided over by Derick Parden Eshun.
The court ordered the accused to remain in police custody and adjourned proceedings to August 27, 2026.
Soldiers Report Incident to Police
Inspector Henry Tetteh Nartey, prosecuting, told the court that the incident occurred on August 23, 2025.
According to the prosecution, WOII Dzisenu and Warrant Officer Class I Yamoah Mark, both stationed at the Base Ammunition Depot at Michel Camp, visited the Afienya Police Station to report a shooting at Mawugbedzibe.
The two soldiers reportedly told police that they had been on their landed property when an unidentified man confronted Dzisenu.
They alleged that the man attacked Dzisenu and attempted to seize his M16 rifle, prompting the accused soldier to discharge the weapon.
Police Find Victim Dead at Scene
Police officers accompanied the two soldiers to the location, where they found Abdul Shaban lying motionless on the ground.
The prosecution said Shaban had what appeared to be a gunshot injury to his upper chest, close to the neck.
He was pronounced dead, and his body was transported to the Tema General Hospital mortuary for preservation and a post-mortem examination.
Investigators retrieved the M16 rifle, identified by serial number 000470-11, along with its magazine and ammunition.
The weapon and ammunition were retained as evidence for further examination.
Autopsy Finds Gunshot Wound to Heart
A post-mortem examination was conducted by Dr. Eric Dumfeh, a pathologist at the Tema General Hospital.
The examination identified a perforating gunshot wound to the heart as the cause of death.
According to the prosecution, the characteristics of the injury were consistent with a near-contact, angled gunshot.
The pathologist’s findings reportedly suggested that the person who fired the weapon was positioned at a higher level than Shaban when the shot was discharged.
A bullet recovered from the deceased’s body was subsequently sent to the Police Forensic Laboratory for ballistic examination.
Statements Taken From Two Soldiers
The court heard that Dzisenu and Yamoah later provided written investigation caution statements in the presence of an independent witness.
Police subsequently duplicated the case docket and forwarded it to the Office of the Attorney-General for legal advice.
Following that advice, investigators formally charged Dzisenu with murder and arraigned him before the Ashaiman District Court.
The case will return to court on August 27 as the prosecution continues the legal process.
The charge against Dzisenu remains an allegation that has not been determined by a court. He is presumed innocent unless the prosecution proves the case against him beyond a reasonable doubt.
