Adu-Boahene’s Lawyers File No-Case Submission in GH¢49.1m Trial

Atta Akyea files no-case for ex-national security boss Adu-Boahene, wife

Lawyers for former National Signals Bureau Director-General Kwabena Adu-Boahene have asked the Accra High Court to end the case against him and his co-accused without requiring them to present a defence.

Lead counsel Samuel Atta Akyea filed a submission of no case to answer on Friday, September 25, 2026, after the prosecution closed its case. The trial also involves Adu-Boahene’s wife, Angela Adjei-Boateng, and a third accused person.

The defence argues that the prosecution has not presented enough evidence to require the accused to answer the charges. It cites alleged gaps in the tracing of GH¢49.1 million earmarked for a cybersecurity project, inconsistencies in witness testimony and the absence of people it considers important witnesses. Atta Akyea has also questioned whether investigators adequately established that the project was not delivered.

The prosecution alleges that three cheques transferred the funds from an account associated with National Security to BNC Communications Bureau Limited, a company linked to the accused, and that the money was subsequently diverted. The state maintains that its financial records, bank statements and other evidence support the charges. Adu-Boahene and his co-accused have pleaded not guilty.

Four prosecution witnesses testified before the state closed its case. The Attorney-General has 14 days to respond to the defence’s submission, after which the defence may file a reply. Justice Francis Achibonga is expected to rule on November 5, 2026, on whether the accused must open their defence or be discharged at this stage.
