AG files an appeal

The Court of Appeal panel, led by Justice Alex Poku-Acheampong and including Justice Bright Mensah and Justice Ackaah-Boafo, ruled by a 2:1 majority that the appeals filed by the first and third appellants should be upheld. This decision was based on their thorough review of the records of appeal (ROA) and a commitment to the law, as stated by Justice Ackaah-Boafo.

 

“As a result,” Justice Ackaah-Boafo stated, “I would allow the appeals, and the trial court’s ruling dated March 30, 2023, which called on the 1st Appellant to open his defense regarding the charges in counts 1 and 5, is hereby set aside. Similarly, the call on the 3rd Appellant to open his defense concerning the charge in count 3 is also set aside.”

 

The court further ruled, “In their place, an order upholding the submission of no case entered for both the 1st and 3rd Appellants in respect of those three counts in the charge sheet is issued. Consequently, both Appellants are hereby acquitted and discharged.”

 

In response to the Court of Appeal’s decision, the Attorney General filed an appeal with the Supreme Court on Thursday, August 8, 2024, seeking two specific reliefs from the higher court.
