Retrial for Gregory Afoko, conviction for Asabke

Gregory Afoko may face a new trial as state prosecutors have few options. In capital offenses such as murder, a unanimous guilty verdict from the jury is required for a conviction. Here, a 7-member jury returned a 4-3 Not Guilty verdict for murder and conspiracy to commit murder. As a result, Mr. Afoko’s co-accused, Asabke Alangdi, was found guilty of conspiracy to commit murder and sentenced to death. In contrast, Mr. Afoko was found not guilty of murder.

However, his legal team is still concerned about the trial’s outcome. They argued the jury was undecided on the more severe charge and asked the court to show mercy in their decision. The Chief State Attorney, Marina Appiah Opare, explained that the punishment for conspiracy to commit murder is the same as for murder, which is death. The court agreed and imposed the death penalty on Mr. Alangdi.
