The Sekondi High Court has lifted the interlocutory injunction against National Democratic Congress (NDC) parliamentary candidate for Amenfi Central, Mrs. Joana Gyan Cudjoe.
With this ruling, delivered on Monday, November 11, 2024, Mrs. Cudjoe is now clear to contest in the 2024 parliamentary elections in Amenfi Central.
The NDC initiated legal proceedings at the Sekondi High Court after the Electoral Commission (EC) refused to recognize Mrs. Cudjoe as its candidate for Amenfi Central, despite a previous ruling in her favor. The dispute followed a setback on Thursday, October 31, 2024, when the Accra High Court dismissed the NDC’s request to halt the EC’s ballot paper printing and the issuance of the notice of poll for Amenfi Central’s election.
The EC had maintained its refusal to recognize Mrs. Cudjoe, despite a May 13, 2024, High Court ruling in Sekondi affirming her as the rightful NDC candidate. The NDC argued that the EC’s stance disregards this ruling, which, they believe, clearly established her candidacy.
This ongoing dispute has fueled months of contention between the NDC and the EC, as both parties hold differing interpretations of the court’s mandate.
Dr. Tanko Rashid Computer, the NDC’s Deputy Director of Elections, explained that the party’s latest legal action was necessary given the judge’s interpretation of the existing injunction, which the NDC felt compelled to challenge once again in court.
