FDA to appeal Hight Court Ruling

The Food and Drugs Authority (FDA) has announced its decision to appeal a recent High Court ruling that favored Tobinco Pharmaceuticals Ltd. The FDA has expressed disagreement with the court’s decision and plans to challenge it, though the specific grounds for the appeal have not yet been disclosed.

 

In a statement, the FDA emphasized its commitment to following the judicial process and upholding the rule of law, ensuring that the case is fully resolved. “The Authority respectfully disagrees with the decision and intends to exercise its right to appeal. We will follow due process until the matter is fully resolved,” the statement read.

 

Additionally, the FDA rejected allegations of negligence against its Chief Executive Officer, Dr. Delese Darko, clarifying that the case relates to actions taken in 2013. The regulatory body affirmed that its leadership has consistently provided a defense in court.

 

The FDA also highlighted that it has “consistently and vigorously” responded to the legal action initiated against it in 2019, reaffirming its dedication to upholding its responsibilities and protecting public health.
