Dr. Cassiel Ato Forson files for an order of mistrial

The Minority Leader, Dr. Cassiel Ato Forson, has submitted a supplemental affidavit supporting his motion for an order of mistrial, injunction, and/or suspension of proceedings.

 

The affidavit refers to a leaked recording in which Attorney General Godfred Yeboah Dame and the third accused, Richard Jakpa, allegedly discuss advising Jakpa to implicate Dr. Ato Forson in the ongoing trial. This recording was presented by the legal team representing the legislators from Ajumako, Enyan, and Esiam.

 

In the affidavit, Dr. Forson’s legal team argues that the Attorney General’s actions constitute misconduct and render the prosecution incompetent.

“It has become necessary to file this affidavit in order to bring to the attention of the Court and, in the interest of justice, certain pertinent, material, and relevant matters that have a bearing on the fair and just determination of the current application.

 

Since filing the instant application, I have had the opportunity to listen to a widely circulated recording depicting the voices of the Attorney-General and the third accused fervently discussing the evidence the Attorney-General prefers the third accused to present at the trial. At the hearing of the instant application, my counsel will seek the court’s leave to play the said audio recording in open court.”
